### Legal Jeopardy: When AI Becomes a Witness

 

The lack of legal privilege has already manifested in high-profile criminal cases, setting a troubling precedent where AI chat logs are treated as actionable evidence.

 The key piece of evidence leading to charges against 19-year-old university student Ryan Shaffer was an indirect digital confession made to ChatGPT shortly after the incident. Shaffer described the scope of the damage and chillingly inquired, “How much trouble am I in, pal? What if I intentionally broke a bunch of cars?”

 

This incident marked what is believed to be the first time AI technology directly implicated a person in a crime based on their conversational input. The police report explicitly cited Shaffer’s “concerning conversation” with the AI as justification for filing charges.

 

Just a week later, the name ChatGPT surfaced again in an affidavit for a far more serious public interest case. Jonathan Rindernknecht (29) was apprehended in connection with the devastating Palisades Fire in California in January, which destroyed thousands of structures and claimed 12 lives.

 Investigators noted that the suspect had allegedly prompted an AI application to generate images of a burning city shortly before the fire occurred, suggesting a premeditation discovered through his AI interactions.

 

These incidents highlight the core danger identified by Sam Altman, CEO of OpenAI (the developer of ChatGPT). Altman has publicly confirmed that conversations with the chatbot carry no legal protection.

 In a recent podcast, Altman stated: “People are sharing their deepest, most sensitive secrets and details about their lives with ChatGPT... Many, especially young people, are using it like a therapist or a life coach to discuss emotional and family issues.

 When you talk to a real therapist, lawyer, or doctor about these sensitive matters, the law grants these conversations confidentiality and legal protection, which conversations with chatbots lack.”

 

### The Scope of Disclosure

 

Given the versatility of large AI models, people employ them for a myriad of tasks—from editing private family photos to interpreting complex loan documents or sensitive rental contracts—all involving highly confidential information. A recent study by OpenAI itself revealed that users frequently seek medical advice, shopping recommendations, and even engage in detailed role-playing scenarios with ChatGPT.

 

  • Furthermore, several AI applications explicitly market themselves as “virtual
  •  therapists” or “emotional partners” without adhering to the stringent
  •  regulatory standards followed by established mental health platforms. In the
  •  darker corners of the internet, or the **Dark Web**, illicit services offer AI
  •  companions that act not just as close friends, but as willing co-conspirators in
  •  potentially harmful or illegal activities.

 

### Corporate Data Harvesting: Meta’s AI Ad Push

 


The immense pool of user-shared data is not just valuable to law enforcement or criminals; major technology corporations are rapidly moving to harness this deep personal data for commercial gain. Starting in December, Meta (owner of Facebook, Instagram, and Threads) will begin utilizing user interactions with its smart tools, notably **Meta AI**, to target users with highly personalized advertisements.

 

  1. Both voice conversations and text messages exchanged with Meta’s AI will be
  2.  scanned and analyzed to pinpoint users’ exact preferences and gauge which
  3.  products they are most likely to purchase. Crucially, users are not provided
  4.  with an option to refuse or opt out of this specific data collection.

 

In a blog post announcing the update, Meta explained: “For example, if you talk to our AI about hiking, we know you are interested in it. Based on that, you might receive notifications and recommendations for hiking groups, posts from friends about trails, or advertisements for athletic shoes.”

 

While this practice may seem benign on the surface, prior studies of targeted advertising on search engines and social media platforms have revealed its potential for severe harm. Users who searched for phrases like “I need financial help,” for instance, were targeted with ads for predatory loans. Similarly, problem gamblers were targeted with ads offering free credit at online casinos, and misleading advertisements reached vulnerable seniors, urging them to spend their retirement savings on overpriced gold coins.

 

Mark Zuckerberg, Meta’s CEO, fully understands the volume of personal data to be collected under this new AI-powered ad strategy. In April, he noted that users would be able to allow Meta’s AI system to “know a lot about you and the people you care about, across our different apps.” This statement carries weight, particularly as Zuckerberg himself previously described early Facebook users as “dumb” for trusting him with their personal information.

 

Pieter Arntz, from cybersecurity firm Malwarebytes, commented on Meta’s announcement: “Whether we like it or not, Meta is not truly a platform for friends around the world to connect. Its business model is fundamentally built on selling targeted ad space across its various applications.”

 

Arntz stresses that the technology industry faces massive ethical and privacy challenges, demanding that AI brands prioritize a balance between hyper-personalization, transparency, and offering users the genuine choice to consent or refuse data usage, especially when AI tools are collecting and analyzing highly sensitive behavioral and personal data.

 

### The New Digital Prey

 

As AI’s role in our daily lives expands, the trade-off between personal privacy and convenience is once again under intense scrutiny. Just as the Cambridge Analytica scandal forced people to reconsider how they engaged with social media platforms after the unauthorized use of millions of users' data to influence political leanings, today’s push toward deeper data aggregation, combined with legal precedents set by cases like Shaffer’s and Rindernknecht’s, is bringing the privacy file back to the forefront of global technological debate.

 

Less than three years after the launch of ChatGPT, the number of independent AI app users has already exceeded one billion. Without realizing it, these users often become vulnerable to exploitation by greedy tech corporations, opportunistic advertisers, or even criminal investigators.

 

The old adage stated: **“If you aren’t paying for the service, you are not the customer, you are the product.”** In the age of AI, it may be more appropriate to revise that maxim: **“If you aren’t paying for the service, you are the prey.”**
